Visitor terms of use Effective date: 27 October 2026 FT-VISITOR-2026-10-R01 1 Who operates this website FumiTours.com is operated by Clear Fountain Pty Ltd, Australia, ABN 17 131 065 051, ACN 131 065 051 (“Fumi”, “we”, “us”). These terms describe the use of our free travel information website. You can contact us using the contact details on our About page at https://fumitours.com/about/. These terms do not replace any separate terms for the paid Fumi app or a business partner agreement. Any purchase is also subject to the offer and terms shown before you buy. Nothing in these terms changes an agreed purchase price or removes your rights relating to a paid service. 2 What the website provides Our guides, itineraries, maps, videos and other material help you explore and plan a visit to Japan. Suggested routes and activities are planning ideas, not a promise that an option will be available, suitable or accessible for every visitor. Consider your circumstances, abilities, budget and travel dates. Unless we expressly agree otherwise in a separate service, we do not book or supply accommodation, meals, transport, luggage delivery or other third party travel services. You arrange those services directly with the relevant provider, under its booking and service conditions. A link or listing does not make that provider our agent. 3 How information is prepared We take reasonable care when preparing and maintaining our content. We use sources such as provider information, official notices, research and travel experience. We do not continuously inspect venues or independently recheck every published detail. A source or checked date identifies the information available at that time; it is not a promise that nothing has changed since. Content can contain mistakes, omissions or outdated details. Providers may change prices, availability, opening hours, routes and conditions without telling us. A recommendation expresses a planning suggestion based on the information available; it is not a guarantee of your experience. These explanations do not remove our legal responsibilities. 4 Prices and availability Third party travel prices and cost examples are indicative unless expressly identified as a current provider offer with stated conditions. They may vary with season, date, occupancy, room or ticket type, menu choice, exchange rate and availability. Taxes, service charges, booking fees and other conditions may also affect the total. Where known, we state the relevant currency and basis of the example. Before ordering or booking, check the provider’s current total price, inclusions and conditions. A currency conversion is an illustration, not a guaranteed exchange rate. Your agreement with the provider determines the actual charge. This clause concerns third party travel estimates; it does not allow us to change a confirmed price for something you buy from Fumi. 5 Confirm important details before relying on them As a responsibility when using our planning information, take reasonable steps to confirm details that materially affect your decision, safety, timing or expenditure. Use the provider’s current information or an appropriate official source before making a booking, payment, delivery arrangement or other significant commitment. Check again where conditions are likely to change. If an important point cannot be confirmed, seek clarification before proceeding. 6 Checks for common travel arrangements For transport, confirm the current route, operating day, departure time, ticket validity, reservation requirements and service notices. A suggested connection or walking time is an estimate and may not allow for your pace, queues, weather or disruption. For accommodation and activities, confirm dates, location, accessibility, check in arrangements, cancellation rules and any age, clothing, reservation or entry requirements. For meals, confirm current prices and dietary or allergy requirements directly with staff. Do not treat a translated menu or general description as confirmation that a meal is safe for a particular allergy. For luggage delivery or storage, confirm acceptance with the receiving property and the carrier, including the booking name, delivery address, intended arrival date, cut off time, size and weight limits, prohibited items and any compensation conditions. Keep passports, necessary medicines and other items you need during transit with you. Do not assume that every property accepts unattended or advance deliveries. These checks are intended to prevent avoidable problems. A failure to make a check does not automatically remove your legal rights. Responsibility for a particular loss depends on the facts and applicable law, including each party’s conduct and what caused the loss. 7 Maps safety and specialist information Maps and route descriptions are planning aids. Follow current signs, transport notices, access restrictions, weather warnings and instructions from local authorities or staff. Conditions on the ground may differ from a description or map. Do not enter a closed or unsafe area because a guide shows a route. Our general content is not personalised medical, legal, immigration or emergency advice. Check entry requirements with the appropriate government authority and obtain qualified advice where your circumstances require it. In an emergency, contact the relevant local emergency service; the website and Fumi assistance are not emergency response services. 8 Translations and AI assisted material Some content or translations may be prepared with AI assistance. AI can misunderstand context, omit information or produce an incorrect answer. For important matters such as allergies, medical needs, legal requirements or delivery instructions, obtain confirmation from the responsible person or official source instead of relying solely on an AI response or translation. Descriptions, illustrations and videos may explain or demonstrate an experience rather than depict its current condition. We will identify material illustrations or simulations where needed to avoid a misleading impression. Our use of AI does not remove our legal obligations. 9 Other providers and linked websites Third party providers are responsible for the services they agree to supply, including their booking terms, payments, refunds and complaints. External websites have their own terms and privacy practices. We do not control their availability or later changes. We will identify promotional relationships where required; a partner listing is not a representation that we independently inspected every aspect of that business. 10 Permitted use of the website You may use the website and save or print reasonable extracts for personal travel planning, subject to any stated third party rights. You must not misuse accounts, interfere with the service, introduce malicious code or present altered Fumi material as our approved content. Other commercial reuse requires permission, unless applicable law allows it. Copyright exceptions and other mandatory rights remain unaffected. 11 Responsibility and legal rights Nothing in these terms excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded, including rights under the Australian Consumer Law and other applicable mandatory laws. You retain any right to a remedy that the law gives you. We do not exclude liability for our fraud, wilful misconduct or gross negligence. These terms also do not purport to excuse our own negligence, misleading conduct or other breach of a duty imposed by applicable law. The fact that the website is free does not create a zero dollar limit on a valid claim. Subject to those protections, we are not responsible for loss caused solely by an independent provider’s breach, a later change to its services or another event outside our reasonable control, where we did not cause or contribute to the loss and applicable law does not otherwise make us responsible. Where more than one person contributes to a loss, responsibility is determined under applicable law. Clauses 5 and 6 do not operate as an automatic waiver or bar to a claim. 12 Reporting errors and resolving concerns Please report a material error through the contact details on our About page. Include the page address, the detail concerned and any current provider or official information that helps us check it. We will assess the report reasonably and in good faith (bona fide) and, where appropriate, correct, qualify or remove the information. Urgent safety or materially misleading information will be prioritised. Please give us a reasonable opportunity to respond to a complaint. This does not prevent you from seeking urgent relief, using an available dispute resolution process or contacting a regulator or court. 13 Availability events outside our control and privacy We may update or remove content, or interrupt access for maintenance, security, legal or other reasonable operational needs. We will give notice where reasonably practicable if a change materially affects an agreed service. Changes to free content do not cancel obligations under a separate paid agreement or erase existing rights. For the free website services, a force majeure event means an earthquake, tsunami, typhoon, flood, volcanic eruption, war, government restriction, or widespread power or communications outage beyond our reasonable control that we could not reasonably prevent or avoid and that directly prevents performance. Subject to clause 11, only the performance directly prevented is suspended, and only for as long as the event prevents it. We are not responsible solely for the resulting delay where we did not cause or contribute to it. We will take reasonable steps to reduce the disruption, give notice where reasonably practicable and resume the affected service as soon as reasonably possible. This provision does not excuse our negligence, avoidable failures or earlier breaches, remove mandatory rights, or change a paid app agreement or a booking with another provider. Personal information is handled as explained in our applicable privacy notice and the collection notices shown when information is requested. Agreement to these terms is not blanket consent to unrelated marketing or data uses. We will identify the applicable notice at the point of collection. 14 Updates and a change of operator We will identify the current version and effective date of these terms. Material changes will be notified in a way appropriate to the service, and fresh agreement will be obtained where required. Changes do not retrospectively remove accrued rights or remedies. If the operator changes, we will identify the new entity and explain any effect on your service or personal information. Any transfer of an existing agreement will be handled in accordance with applicable law, including obtaining consent where required. Merely changing a company name on the website does not remove existing responsibilities. 15 Governing law These terms are governed by the law of New South Wales, Australia, subject to mandatory laws that apply to you or the service, including applicable Australian Consumer Law protections and relevant mandatory Japanese and United States federal or state laws. New South Wales courts have nonexclusive jurisdiction. This does not prevent you from relying on mandatory protections or bringing a claim in another court where the law gives you that right. An invalid provision is separated only to the extent necessary, leaving the remainder effective where lawful. COMPANY AND CONSUMER RIGHTS FumiTours is developed and operated by Clear Fountain Pty Ltd, an Australian private company whose ABN has been active since 20 May 2008.
